NOTICE OF EXECUTION SALE In accordance with the terms and provisions of an execution issued to the undersigned, sheriff of Washing ton County, by A. J. Maxwell, Com missioner of Revenue of the State of North Carolina, against John L. Rop er Lumber Company, on account of the failure of said corporation to pay its franchise tax to the State of North Carolina, and by virtue of the power and authority of said execution and of the laws in such cases made and provided, the undersigned will, on Monday, September 4, 1933, at 12 o' clock noon, at the courthouse door of Washington County in the Town of Plymouth, expose for sale at public auction to the highest bidder, for cash, the following described lands: Regis tered Estate No. 368, certificate of title for which is of record in the of fice of Register of Deeds of Wash ington County in Registration of Land Titles Book 6, page 218, lying and be-! ing in Lees Mill Township, and be-j scribed as follows: Beginning at an iron marker where' the Big Ditch formerly intersected the northern edge of the Main street of Roper; running thence north 41 de-j grees SO minutes west 3320 ft, with! the Roper Lumber Company’s line, to an iron marker on the edge of Ken dricks or Mackeys Creek; thence down the various courses of said creek 1054; ft. to an iron marker; thence south 37 degrees, 20 minutes east 3466 ft. to an iron marker on the northern edge of the Main street of Roper; thence along the main street of Roper, south 57 de grees west 214 ft. to the southwestern corner of a tract of land conveyed by John I,. Roper Lumber Company to C. E. Mizell by transfer dated June 9, 1923, for a divided part of said reg istered estate, thence north 34 de-' grees 30 minutes west 171 ft.; thence j south 55 degrees 30 minutes west 64 i ft.; thence south 34 degrees, 30 min-I utes east 171 ft. to the northern edge of Buncombe or Main Street; thence with the line of the said street north 57 degrees east 196 ft. to the point of ; beginning; being all of said Regis tered Estate No. 357, book 6, page 98, except that part which has be< n con- , veyed by John L. Roper Lumber t om pany to C. E. Mizell, containing 48.25 acres. Those three certain houses and lots lying on the north side of the Norfolk Southern Railroad in the Town of Roper and adjoining the lot upon which is now located a filling station, same fronting on Railroad Avenue, and being bounded on the east by said filling station lot and the Hooker lot, on the south by Railroad Avenue, on the west by Cypress Street, and on the north by an alley and the Hooker lot, same to include all the land en closed and used as lots for the use of the dwelling situated thereon, and up on which is located an office former ly used by Dr. J. \V. Speight, and three dwelling houses and outbuildings for the use thereof. All that certain property owned by John L. Roper Lumber Company in the town of Roper, N. C, located on the south side of the Norfolk South ern Railroad, on the west side of Main Street or Buncombe Avenue and de scribed as follows: Beginning at the south edge of the right of way of Norfolk Southern Railroad at the west edge of Main Street or Buncombe Avenue, and running thence along the southern edge of the right of way of Norfolk Southtrn Railroad to Ken drick’s Creek, thence up Kendrick’s Creek at its various courses so far as the property of John L. Roper Lum ber Company adjoins said creek; thence northwardly and eastw’ardly a 1c ng the line between John L. Roper Lumber Company and various prop erty owners, including Thomas Wil kins. Owens, et als, to the western edge of Main Street or Buncombe Avenue; thence northwardly along the western edge of Main Street or Bun combe Avenue to the beginning, upon which is now situated the old John L. Roper Lumber Company store build ing, and various other buildings, and upon which formerly stood the saw mill, planing mill, and shingle mill of John L. Roper Lumber Company.
